Terms of Service

These terms of service ("Terms") apply when you buy digital content from Indie eBooks at https://www.indieebooks.com (the "Site"). The Site is operated by Innovative Content Solutions LLC ("we", "us", "our"), contactable at 2525 Annunciation St, New Orleans, LA, 70130 or support@indieebooks.com. By placing an order you agree to these Terms, so please read them before buying. If you do not agree to them, please do not use the Site.
1. What we sell
We sell digital content: eBooks supplied as downloadable files (PDF, EPUB and/or DOCX, as listed on each product page). No physical product will be shipped. Each eBook remains the copyright of its author or publisher.
2. Ordering and payment
You place an order by adding eBooks to your cart and completing payment through PayPal. All payments are processed by PayPal; we never see or store your card details. Prices are shown in US Dollars and include any applicable taxes unless stated otherwise. A contract between you and us is formed when PayPal confirms your payment.
We take reasonable care to describe and price every eBook accurately. If we discover a genuine pricing error in an order you have placed, we may cancel the order and refund you in full.
3. Delivery
Delivery is by digital download. Once PayPal confirms your payment, your download links become available on our My Downloads page, normally within one minute. To access your files, you enter the PayPal Transaction ID from your receipt together with the name and email address used at checkout. You can return to that page at any time to re-download your purchases at no extra cost. If your payment is made by eCheque or is otherwise held by PayPal as pending, your downloads become available once PayPal completes the payment.
4. Your right to cancel, and when it ends
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel an online purchase. For digital content, that right ends once the content is supplied with your express consent. By completing checkout you expressly request immediate delivery of your eBooks and acknowledge that you lose your statutory right to cancel once delivery has begun. 5. Licence of use
When you buy an eBook you receive a personal, non-exclusive, non-transferable licence to download, store and read it on devices you own, for your personal, non-commercial use. Our files are supplied without DRM as a courtesy to you; this is not a transfer of copyright. You must not sell, publish, redistribute, share publicly, sub-license or make the files available to others, and you must not remove any copyright notices. Authors depend on these sales for their income.
6. Acceptable use of the Site
You must not misuse the Site, including by attempting to gain unauthorised access to it, interfering with its operation, scraping its content at scale, submitting false transaction details, or using it for any unlawful purpose. We may suspend access to download facilities where we reasonably suspect fraud or abuse, including fraudulent chargebacks.
7. Availability
We aim to keep the Site and your re-download access available at all times but do not guarantee uninterrupted availability. We may withdraw a title from sale at any time; doing so does not affect downloads you have already purchased, which remain available to you through the My Downloads page.
8. Our liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law, including your statutory rights as a consumer under the Consumer Rights Act 2015. Subject to that, we are not liable for loss or damage that is not foreseeable, for loss arising from your use of the eBooks in business or trade, or for loss caused by events outside our reasonable control. Our total liability to you in connection with any order is limited to the price you paid for that order.
9. Personal data
We process the personal data needed to fulfil your order and provide re-downloads, as described in our Privacy Policy and Cookies Policy.
10. Changes to these Terms
We may update these Terms from time to time. The version published on the Site when you place your order is the version that applies to that order.
11. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or any purchase from the Site, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction - except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and nothing in this clause deprives you of mandatory consumer protections in the country where you live.
